Orlando Woman Charged With DUI With Serious Bodily Injury After Crash Critically Injuring 2 Young Children In Frostproof Crash

32-year-old Ashauntie Cox (DOB 2/15/1991) of Orlando, who caused serious bodily harm to two children in her vehicle while fleeing from two crashes and driving under the influence, was arrested in Polk County on Friday, May 19, 2023, and charged with several felonies.

According to witnesses and information developed during the investigation, the first crash occurred around 8:00 p.m. on US Hwy 27 at the intersection with US Hwy 98 near Frostproof. Cox was driving a blue Kia southbound on Hwy 27 when she struck a grey Chevy Silverado pickup truck and then fled at a high rate of speed. As she continued to recklessly speed south down Hwy 27, weaving in and out of slower moving traffic, she rear-ended a 2016 Honda CRV while trying to pass between that SUV and the vehicle next to it which were both also going southbound. The victim driving the CRV was taken to Sebring Hospital, where he was treated and released with minor injuries.

The collision caused Cox’s vehicle to flip several times, ejecting two Orlando children, ages 5 and 8 years old. Both sustained significant injuries, and they were taken to Tampa General Hospital where they are both in critical condition. A 27-year-old female passenger was also seriously injured along her spinal cord, hip, and back. She remains at Lakeland Regional Health Medical Center in stable condition.

When deputies arrived at the scene of the crash, they detected the odor of marijuana and located a bottle of tequila in Cox’s vehicle. Cox was transported to the hospital and interview by deputies. Cox told deputies they were driving from Orlando to Avon Park to celebrate the 5-year-old’s kindergarten graduation. She admitted to smoking marijuana earlier in the day, and to having four shots of tequila. Her blood was drawn for further analysis, and she displayed several signs of impairment. 

She was booked into the Polk County Jail and is being charged with:

·        Three counts DUI with serious bodily injury (F3)

·        Two counts negligent child abuse with great bodily harm (F2)

·        Reckless driving (F3)

·        One count DUI with property damage (M1)

·        One count DUI (M2)

Further charges are pending the outcome of the investigation. 

“This woman had no regard for anyone’s life when she got behind the wheel intoxicated and then drove recklessly down a major highway, but what’s worse is the blatant disregard she had for the lives of the innocent children in her car. I expect a successful prosecution to hold her accountable—and let’s hope she loses her driving privileges if she’s released from jail or prison. LWPD Working Crash At Burns Ave & Scenic Hwy

The Lake Wales Police Department is working a traffic crash at the intersection of Burns Ave and Old Scenic Hwy.

There are two vehicles involved, a black car and a gray suv. One occupant from each vehicle is being transported to local hospitals as a precaution.

There are no life threatening injuries. Eastbound and Westbound traffic on Burns Ave have been re-routed but a tow truck is on scene to clear the roadway. Traffic flow will return to normal shortly.

Lake Wales City Manager Seeking Employment Elsewhere

Lake Wales, Florida – The Daytona Beach News-Journal, in it’s April 22 online edition, is reporting that Lake Wales City Manager James Slaton is one of 13 candidates chosen to be a semi-finalists for its vacant city manager position.

The news comes as a shock to many in the community. Slaton has been an employee for the city for almost 19 years (June of 2005). He spent 7 years as the cities Director of Information & Technology. He also spent various time as Director of Support Services, Director of Public & Support Services and Deputy City Manager. Since June of 2020 Slaton has been city manager for Lake Wales.

The Next Step For The City Of New Smyrna

“The next step is to prepare each semifinalist for the interview process, according to Thomas.

They will complete “a fairly detailed” questionnaire and participate in video interviews and a media search by SGR.

After the City Commission reviews the information, it will select three to five finalists for the next phase. This will take place during a public meeting at 5:30 p.m. May 16.” according to the The Daytona Beach News-Journal.

Recent Decisions Dogging Lake Wales City Manager

Recent decisions, regarding the Lake Wales Police Chief, by Slaton has put him at odds with most of the constituents at one point or another. A grievance was filed against Chief Velazquez for his handling of advancement of staff to Lieutenant positions. The grievance felt race was an issue in the selection process and that a reposting of the position allowed one member an opportunity that the grieved felt was not fair. An independent company reviewed information gathered by the cities Human Resources Manager, Sandra Davis, and they concluded no racism occurred, but the appearance of favoritism and nepotism existed, but fell short of saying it occurred. The independent review also did not find that Chief Velazquez broke any rules by the city in his actions. It found that the chief was not consistent in how he handled job postings. This prompted Slaton to write a memo to Chief Velazquez instructing him that he was going to seek a replacement and relieve him of his duties once a replacement was found. “On April, 2024, I will advertise a search for a new police chief. You may remain in your current position until a new chief has been appointed.” said Slaton. This memo was provided to an organization named the Poor Minority Justice Association who leaked it to the media (entire memo here). This all happened on Monday March 11 as Chief Velazquez left on a family vacation cruise. A little over a week later, without much explanation, Slaton addressed the commission and advised he had changed his mind.

The memorandum coming out to the public without any further explanation and the fact it was sent the first day the chief left on vacation didn’t sit well with many residents. It allowed no opportunity for the Chief to even respond to the accusations or the memorandum. Additionally it brought into question why the police department was in charge of job postings and not the Human Resources Department, who has a much better understanding of labor laws and job postings.

The reversal decision by Slaton with little response to the public didn’t sit well with many residents. It even prompted Lake Wales City Commissioner Daniel Williams to state the following “I need everyone to know that when you see black people in the City of Lake Wales right now, and they’re frustrated, they got a reason to be frustrated,” Williams said. “We can handle anything if you tell us the truth. But if it seems like you said one thing today and then certain people call and then things get changed it makes us feel like we still up under Jim Crow, and we ain’t going back there!” 

“You have literally today told black people that power is more, and…or color is greater in this city,” Williams said. “I am extremely frustrated about how this went down.”

This coming from a sitting city commissioner was extremely damning of Slaton and sent a clear message a rift between the two had occurred.

This news brings more questions than answers at a time when so much is occurring in the central Florida city.

In Loving Memory Of John “Jack” Kostelic

John “Jack” Kostelic of Lake Wales passed away Tuesday, April 9, 2024 at his residence.

He was born January 10, 1937 in Aurora, Minnesota to the late John and Angeline Kostelic; he moved to Lake Wales from Michigan in 1995. John was a retired Supervisor of a railroad car fabrication company and was of the Catholic faith. He was a classic car enthusiast and car collector. John enjoyed sports and was a fan of the Lions, Patriots and Buccaneers. In his younger years, he also enjoyed boating, motorcycles, and snowmobiles. John was a jokester and a great storyteller. He loved music and his favorite musicians were Elvis, Tom Jones, and Tina Turner.

John was preceded in death by his parents, John and Angeline Kostelic. He is survived by his wife of 65 years, Nancy Kostelic; daughter, Debra Jackson True (George “Skip” True, III) of Lake Wales; grandson, Cody William Jackson (Brianna Berwind); step-grandson, George True, IV; great-grandchild, Brooklyn Alicia Jackson; and many nieces and nephews that he was very good to.

A  celebration of life will be held from 2:00 p.m. until 5:00 p.m., Saturday, April 27, 2024 at his daughter’s home. In lieu of flowers, memorial donations in her honor can be sent to Vitas Hospice.

In Loving Memory Of Shirley Beaver

Shirley Louise Erthum Beaver, our mother, 85, passed away peacefully on March 26, 2024. Born in Geneva, Nebraska, she was raised on a farm and was the youngest of four sisters. There, she learned the value of hard work and was always quick to correct Dad’s tales of a tough upbringing.

In 1955, Mom won the Brunette Division Fillmore County Beauty Contest and later became the head majorette of Geneva High School. On August 3, 1957, she married the love of her life, Jim Beaver, from York, Nebraska. They honeymooned in Florida and soon after made their home in the town of Frostproof, Florida, where they lived for 40 years.

Mom and Dad welcomed eight children into the world, providing strong family values and teaching life lessons along the way. Mom was a Husker through and through, and on game days, you could bet she would be singing the Husker fight song with Dad as she danced and twirled her baton.

Mom’s fried chicken was a favorite, and she loved cooking for everyone. Her laughter and smile were infectious, leaving a lasting impression on all who knew her.

Mom had many interests and talents; she enjoyed gardening, fishing, playing cards, and putting puzzles together, always claiming the edge pieces. Camping at Arbuckle and spending time at the lake were cherished family pastimes that created memories we will forever hold dear. Most of all, Mom loved dancing with Dad, and their love inspired us all.

Mom leaves behind a legacy of love, kindness, and joy that so many will forever cherish. She is survived by her sister, Jean Erthum; her children, Bruce, Shelly, Jenny (Conley), Jamie, Chuck (DeeDee), John (Cathy); her grandchildren: Brad (Kathryn), Matt, Casey (Robert), Haley (Ron), Jenna (James), Nikki (Doug), Trey, Chaz, Jayma (Logan), McKenzie, Tara, and 13 great-grandchildren.

She is preceded in death by her parents, Al and Fay Erthum, her daughter Rachelle, her son Nick, her husband, James Beaver, and her sisters Dorothy Gruenemeier and Carol Bagby. 

Mom’s light will continue to guide us, and her love will forever be in our hearts. We will miss her dearly, but we take comfort in knowing Mom is in Heaven dancing with Dad once again.

All are welcome to the memorial service, which will take place at Marion Nelson Funeral Home, 454 South Buck Moore Rd, Lake Wales, FL 33853. The service will be Sunday April 21, 2024, at 4:00 p.m.

Lake Wales Police Conducting Death Investigation At Local Gas Station Parking Lot

On the morning of April 17, the Lake Wales Fire Department and Lake Wales Police were called to the Citgo Gas Station at the intersection of Burns Avenue & Scenic Hwy. They were called because a middle age gentleman was found unresponsive in his car.

According to the Lake Wales Police Department the man was transported to the hospital, but passed.

The call came in around 11:39 am.

According to Troy Schulze, Deputy Police Chief, no immediate foul play was observed. An autopsy and toxicology screen will be performed to determine cause of death.

At this time it doesn’t appear any danger to the public. This is an ongoing investigation and we will update as more information is released.

Larry Piatt of Lake Wales, Fl passed away Saturday April 16th at Good Shepherd Hospice in Sebring, Fl.

He was born December 28th,1951 in Waynesburg, Pa. to the late Norman and Violet Piatt.

He moved to Lake Wales in 1969. He was a retired mechanic at Duke Energy for 43 years. He was of the Baptist faith. He also was a member of the Lake Wales Masonic Lodge as well as a charter member of the Lake Wales Moose Lodge 2391.

He loved his family, friends, his Harley, and playing with his grandson Jax. Larry survived by his loving wife Linda of 30 years. Daughter Kayla (Justin) Land and grandson Jaxton Land of Winter Haven Fl. Sister Karen (Ed) Dees. Niece Emily (Josh) Griffin. Grand niece Ireland, Grand nephews Jaxson and Brett of Plant City Fl. Bonus daughter Amanda (Josh) Christian and two bonus granddaughters Gianna and Rylann Rae of Winter Haven, Fl. And dogs Harley and Gus.

Celebration of life will be held at First Baptist Church of Lake Wales May 4th at 11:00. Reception to follow at Lake Wales Moose Lodge.

Lake Alta Park Remains! Lake Wales City Commissioners Vote Against Controversial Proposal to Transfer City Land to Private Developer

Residents living near Lake Alta Park can rest peacefully knowing that the 3.5-acre piece of land will remain intact and not have its ownership transferred to a private developer.

Lake Wales City Commissioners voted against two ordinances that would have amended the future land use and zoning designation to a parcel of land known as Lake Alta Park.

Both ordinances would have changed its land use designation from “Public” to “Low-Density Residential”, and the zoning from “Recreation” to “R-1C Residential.”

The parcel is located north of Kissimmee Avenue, east of 3rd Street North, south of Osceola Avenue East, and west of 4th Street North.

Lake Alta Park, as it is known by residents, had been transferred by the city to the Community Redevelopment Agency, which was considering transferring the land to a private developer.

The proposed land use and zoning change would have allowed the developer to construct 24 cottage-style homes on approximately 1.7 acres. The current zoning and land use designation would have only permitted half the number of homes.

As for Lake Alta Park itself, the land would have been left open to the public and maintained by the HOA associated with the cottage homes.

However, residents living nearby had raised concerns about the city transferring public land to a private developer, as well as the main complications the potential development could have created with traffic and parking.

While both ordinances had initially passed their first reading during a previous city commission meeting on Mar. 19, both ordinances were voted against during their second reading at the recent meeting on Tuesday with a vote of 3-2.

Mayor Jack Hilligoss and Commissioners Daniel Williams and Keith Thompson voted “nay” on both ordinances.

Mayor Jack Hilligoss, while he understood the hard work of the planning team and the good faith of the developer, voted against the ordinance due to the overwhelming citizen outcry against it.

“Folks around here don’t want this,” he said. “This is where I stop. I cannot vote in favor of this.”

Commissioner Robin Gibson voted in favor of both ordinances. He claimed that the development would have been similar to Baldwin Park in Orlando. He called it “one of the finest neighborhoods” in Orlando, especially since it was a traditional design neighborhood like was proposed in the Lake Wales Envisioned Plan.

“The property value in the neighborhood have gone up considerably, [especially with] the quality of the design and construction there,” Gibson said. “They have done a great deal for Orlando.”

“But we are not Orlando,” one member of the audience called out.

Linda Suzanne Wetzel of Lake Wales passed away Sunday, April 14, 2024 at AdventHealth Lake Wales.

She was born August 17, 1949 in Detroit, Michigan to the late Frederick and Luisa Dunham; she moved to Lake Wales from Michigan in 2000. Linda was a retired telecommunications operator. She loved working plants and being in her craft room. Linda loved her dogs.

Linda was preceded in death by her daughter, Luisa Martin; and son, Richard Joe Martin. She is survived by her husband of 36 years, Ken Wetzel; son, Brandon Wetzel of Lake Wales; brother, David Dunham of Lake Wales; grandchildren, Cassandra Flores and Emilia Kohls; and two great-grandchildren.

No services are scheduled at this time. 

LWPD Arrest DUI Suspect Who Was Never Issued Drivers License

The Lake Wales Police recently stopped a man driving on SR 60 and swerving down the road. This stop resulted in the arrest of Filadelfo Hernandez-Gabriel. Mr. Hernandez-Gabriel reported to the arresting officer he has never been issued a drivers license.

Here is an excerpt of the arrest affidavit. (It should be noted that this is an unedited report of facts by the Lake Wales Police Department. These facts are up for question and everyone is entitled to question the validity of facts by law enforcement in a court of law. The Lake Wales Daily does not rewrite these facts as some meanings or interpretations could be in error and change context. We hope readers appreciate being able to read the information and come to their own understanding and conclusions) :

“On 04/10/2024, while traveling east on Hwy 60 near High St., I observed a dark color Ford Explorer traveling in front of my patrol vehicle. The vehicle was crossing over the dividing lines going over both sides and almost hitting the curb. The vehicle was on the outside lane and was drifting over to the inside lane, then back to the outside lane over the solid white lane almost hitting the curb.

I conducted a traffic stop and the vehicle came to a stop in the RaceTrac parking lot. I made contact with the driver, Filadelfo Hernandez-Gabriel, who appeared intoxicated; I could smell the odor of alcoholic beverage emitting from his breath, his eyes were watery and bloodshot, and his speech was slurred. I asked Hernandez-Gabriel for his driver’s license, which he fumbled in his wallet searching for a long period of time. I eventually interrupted his search and asked him if he was ever issued a license in the U.S, which he stated he was never issued one.

I had Hernandez-Gabriel exit the vehicle and asked him to walk to the rear, which I observed him stumble and he appeared to have a difficult time maintaining balance. Post Miranda, Hernandez-Gabriel admitted to consuming 6 Modelo beers, not including a Modelo beer in his cup holder.
advised Hernandez-Gabriel I suspected him of driving under the influence and asked him if he was willing to perform field sobriety exercises, which he agreed. I first conducted the Horizontal Gaze Nystagmus exercise. During the exercise, Hernandez-Gabriel was swaying and had a difficult time maintaining balance. I observed lack of smooth pursuit, distinct and sustained Nystagmusat maximum deviation, and onset of Nystagmus prior to 45 degrees. Additionally, Hernandez-Gabriel kept following the stimulus with his head and stopped tracking it during several occasions.


Next I conducted the Walk and Turn exercise. During this exercise, Hernandez-Gabriel missed heal to toe numerous times during both 9 steps. Additionally, he raised his arms and fell off the line multiple times.


I then conducted the One Leg Stand exercise. During this exercise, Hernandez-Gabriel had a very difficult time maintaining his balance. He put his foot down several times and was not extending his leg and toes outwards as instructed. Hernandez-Gabriel was unable to count past 6 seconds and used his arms to attempt to regain balance.


At this point, I placed Hernandez-Gabriel under arrest and transported him to the Polk County Processing Center where I initiated his 20-minute observation at 0055 hours. At 0115 hours, After the observation period, Hernandez-Gabriel consented to a breath test: the first sample showed 0.143g/210L of breath, the second sample showed 0.140g/210L of breath.


I also ran Hernandez-Gabriel through FCIC/NCIC, who confirmed he was never issued a driver’s license.


Based on my investigation, probable cause exists to charge Hernandez-Gabriel with F.S 316.193(1) -driving under the influence,and F.S 322.03(1) – No drivers license, for operating a motor vehicle on city roadway while impaired.”
