Pair Arrested For Trespassing And Burglary In Lake Wales

The Lake Wales Police Department arrested London Montgomery (DOB 3/9/1961), of Lake Wales, on August 6 and he was charged with Unarmed Burglary – Unoccupied Dwelling. His Co-Defendant, Tonya Duashaye Rivers, date of birth and place of residence unknown, was arrested and charged with trespassing due to her, not being invited into the residence, and remaining inside throughout the night.

It should be noted that this is an unedited and redacted report of facts by the LWPD. These facts are up for question and everyone is entitled to question the validity of facts by law enforcement in a court of law. We hope readers appreciate being able to read the information and come to their own understanding and conclusions:

“On August 6th, 2024, I responded to (REDACTED) Lake Wales, Florida, 33853, in reference to subjects breaking into the residence. The residence is currently unoccupied, but owned by Sandra Smith Tibado. Sandra’s daughter Paula Melvin and her husband are remodeling the residence, so much of the interior is under construction. Sandra has made Paula the agent of the residence.

“Due to a recent burglary of the residence, Paula and her husband placed cameras inside the residence. Paula called 911 and reported seeing a subject inside the residence at 0230-0300 hours. When I arrived at the residence, I observed a black bicycle and a bicycle cart at the rear of the residence, and the window was open.

“Canine Officer Ricks L407 arrived on scene and deployed his partner, Canine Bane, from the rear open window for anyone occupying the residence to make their presence known. When Officer Ricks, deployed Canine Bane into the residence, an unknown male subject stated, “Who’s there.” I stood at the front of the residence. Eventually, Tomyah Duashaye Rivers and London Montgomery came to the rear window.

“I climbed through the window and detained both Tomyah and London in my agency issued handcuffs; however, due to all doors in the home being secured by padlocks or screws, I took the handcuffs off Tomyah and London. I had them climb out the window they climbed in, and they were resecured in handcuffs outside the residence.

“Both were escorted to my patrol car and placed them in the back seat while I contacted Paula. Paula said she spoke with Sandra, and she wanted to prosecute for trespassing. Paula said nobody was given permission to enter the residence.

“I spoke with London, and he claimed he knew the owner. London said the owner was “Sandra,” and he would mow her lawn. London said he was never asked to mow Sandra’s lawn, but would mow it to be helpful. London said it was raining during the night, so Tomyah and him went inside the residence for shelter.

“I searched the residence and located a syringe with a liquid and apparent blood mixed inside. I utilized a number 15 Narcotics Analysis Reagent Kit (NARK) to confirm the nature of the liquid inside the syringe. The NARK showed positive results for the presence of Methamphetamine. The syringe was on the floor by a children’s small mattress. I also located a pink backpack in the kitchen area. I confirmed through Paula the backpack did not belong to anyone in her family. I asked Tomyah the backpack was her property, and she immediately said “Yes.” Tomyah went on to say no drugs inside the residence were hers. I asked Tomyah about the syringe, and she said it belonged to London. Tomyah said she helped London “Find a vein,” to inject the liquid inside the syringe.

“London and Tomyah were transported to the Lake Wales Police Department. London and Tomyah were questioned by Detective Sittnick and Detective Raines. Detective Raines informed me that London, post Miranda, told him the syringe belonged to him, and that London said he used the syringe to inject B12 for his back pain.

“Due to Tomyah not being invited to the residence, and remaining inside through the night, she was arrested and charged with trespassing. London was also not invited into the residence, and while he remained inside, he possessed and used a syringe with methamphetamine. London is being charged with burglary of an unoccupied residence.”
